1. General conditions
1.1. The terms and conditions apply to the legal relations between the customer (hereinafter the Client) and the owner of the shop located at estecofood.eu (hereinafter referred to as the e-shop), Tarmere TÜ (hereinafter Seller) regarding the purchase of E-store products. In addition to these conditions, legal relations arising from the purchase of products in the E-shop are governed by the legislation in force in the Republic of Estonia.

2.1. All prices displayed in the e-shop are in euros and include VAT.
3.1. In case the Customer submits an order, but it becomes evident that this product is not available at the moment, the E-shop can not fulfill the order immediately. Upon receipt of the product, the Client will be informed about this (you should select a pre-notification email).
In case the product ordered from the e-shop can not be delivered for any reason and therefore the order is not fulfilled, the full amount of the purchase will be returned to the Client as soon as the delivery of the product becomes impossible and the Client is informed about this.
4. Payment methods
4.1. Secure payments can be made through the Payment Center, which allows you to pay through Estonian bank links or credit card, as well as invoice.
4.2. The seller does not have access to the Client’s banking data and credit card information.
5. Making purchase
5.1. The customer chooses the desired product from the e-shop and adds it to the basket by clicking the “Add to Cart” button.
5.2. After entering the required data and verifying the correctness of the data, the Client confirms the order by clicking on “Submit Order”. After this activity, the order has been confirmed and sent to the seller.
5.3. The customer pays for the product instantly through the Internet Bank’s Payment Center and confirms the payment to the Seller.
5.4. After the payment, the e-shop sends an order confirmation to the Customer’s e-mail.
5.5. The Client undertakes to submit the necessary and correct data for completion of the order.
5.6. The Seller is not responsible for the impossibility of performance due to incorrect data provided by the Client or for any consequent consequences arising from the execution of the order.
6.1. The customer can choose between Itella SmartPost delivery methods.
6.2. By choosing the delivery method, Itella SmartPost will deliver the product to the address selected by the Client within 1-2 business days from the date of sending the confirmation of the order to the Customer’s e-mail address.
6.3. If the order has been completed during the weekend (on a Friday after 13:00 until Monday 09:00) or on a public holiday, the 3-day working day will start at 09:00 on the first working day following the weekend or the public holiday.
6.4. The customer is required to verify the correctness of the submitted contact information before ordering, in order to avoid delays and misunderstandings in the delivery of the products. The seller is not responsible for delays and misunderstandings, if the delay or misunderstanding is due to the inaccuracy of the information provided by the Client during the execution of the order.
6.5. In case the product does not reach the Customer in good condition and in a sealed package, the Client is obliged to inform the e-shop by sending an e-mail to the corresponding e-mail firstname.lastname@example.org or by calling +372 5636 7225.
7. Returning the order
7.1. The customer has the right to withdraw from the order without giving any reasons within 14 days and return the ordered product / products. This 14-day deadline starts from the moment Customer receives the Order.
7.2. An order for cancellation has to be submitted within 14 days from the receipt of the goods. An application for withdrawal is deemed to be filed if the Customer has sent a completed Order-cancellation form to the Seller’s e-mail address email@example.com. Upon receipt of the Order sent by the Customer in the form of withdrawal, the Seller shall send a confirmation to the Client that he has received the Order for cancellation form.
7.3. The customer must return the goods within 14 days after the submission of the application or provide proof that he/she has delivered the goods to the logistics company during the 14-day period, or he/she wishes to bring the product himself/herself to the premises. The customer must ensure that the product remains intact until it reaches the Seller. In order to keep the package healthy, the Client is obliged to open the product packaging with care, without damaging it.
7.4. Returned product must be sent to the following address:

7.5. If the returned product has reached the Seller, the Seller will send the Customer confirmation of the product reaching the Seller.
7.6. The Seller returns the purchase amount to the Client within 14 days from the moment the Product returns to the Seller. Refund will be made to the same bank account that was used to make the payment. The Seller’s bank account numbers can be found on the Seller’s website.
7.7. In case of returning the order, the Seller returns to the Client the total purchase price of the returned product, except for the delivery cost of the product.
7.8. The Seller does not compensate the transportation cost to the Customer in case returning the products.
7.9. The returned product must not be damaged or imprinted and the product must be in the original packaging. In the event of deterioration in the condition of the Product to be returned, the Client shall be liable for the reduction of the value resulting from the use of the product only if he has used the product in any other way than is necessary to satisfy the nature, characteristics and operation of the item. In order to ascertain the nature, characteristics and operation of the product, the Client must handle and use the product only as if it would normally be allowed to do in the shop.
8.2. The seller is responsible for the sales price of the product.
8.3. The Client undertakes to use the E-shop for the sole purpose of law and good practice.
9. Claims procedure
9.1. In the event of non-compliance or defects in the product, the Client undertakes to notify the Seller immediately by sending the Client’s contact details, exact problem description and Order confirmation number to e-mail firstname.lastname@example.org.
9.2. All complaints will be reviewed and the Client will be contacted as soon as possible, but not later than within 15 days from receipt of the complaint.
9.3. The Client has the right to require the Seller to reduce the purchase price of the product or to terminate the contract and refund the product if the Seller is not in a position to repair or replace the product, repairing or replacing of the product fails, the Seller has not eliminated the defective product within a reasonable time, unreasonable inconvenience to the Client .
9.4. The seller is not responsible for any damage caused by the not targeted use of the ordered product, as well as for delay in delivery, if this is due to circumstances beyond the control of the Seller and/or due to force majeure which is not attributable to him.
9.5. The Seller does not reimburse the Customer for expenses incurred in the event of non-compliance or deficiencies in the product, if:
• the value of the product has fallen / the product is damaged due to Customer’s fault
• the value of the product has decreased due to natural wear and tear caused by normal use.
• there is no document certifying the purchase
9.6. We treat each problem as a separate incident and try to find the best solution for both parties.
10.2. A sales contract comes into effect between the Seller and the Client from the date of receipt of the payment to the Seller’s current account.
11. Other conditions
11.1. Disputes between the Customer and the Seller will be settled by negotiation.
11.2. Prices and availability of goods may change without notice. In this case, estecofood.eu (Tarmere UT) reserves the right to withdraw from the sale and return the money to its customer’s account within 14 calendar days.
11.3. The Estecofood.eu e-shop reserves the right to withdraw from the sale if the product has experienced one of the following problems: there has been a human error in entering the product price or a technical error in the system (for example, if a payment of 10€ is worth 1€ , this is a obvious error. therefore, we assume that the Client should understand that this is a mistake and that the product is not sold at such a price).
11.4. Product information is checked and refined on a regular basis. Data may be updated beyond your last visit and may contain minor inaccuracies in product information.

If the buyer and the Web store can not resolve the dispute by agreement, the buyer can contact the Consumer Dispute Committee. The Consumer Disputes Committee is competent to resolve disputes arising from a contract between the buyer and the Web Store. The client’s complaint to the Commission is free of charge.
